Fees and charges

Annual membership fee is waived for primary and supplementary cards (by invitation). Interest (APR), late-payment charges, cash-advance fees, and cheque/payment return fees apply as set out in the Most Important Terms and Conditions (MITC) and monthly statements. All fees are exclusive of applicable taxes such as GST. The full schedule appears in the Cardmember Agreement below.

HSBC Privé Cardmember Agreement

Article 1 — Definitions

1.1. "Annual Percentage Rate (APR)": The annual rate of interest applicable on the Card Account for revolved balances, cash advances, and other charges as specified in the Schedule of Charges. 1.2. "Billing Cycle": The period between the dates of two consecutive billing statements. 1.3. "Card Account": The account opened in the name of the Cardmember for the purpose of entering into Transactions under this Agreement. 1.4. "Cash Advance": Any cash withdrawal made by the Cardmember using the Card at an ATM, bank branch, or other authorized outlets. 1.5. "Charges": All amounts charged to the Card Account, including but not limited to the cost of goods and services, Cash Advances, fees, interest, taxes, and any other amounts levied under this Agreement. 1.6. "Credit Limit": The maximum outstanding amount the Bank permits the Cardmember to have on the Card Account at any point in time. 1.7. "Merchant Establishment": Any entity, in India or abroad, that accepts the Card for payment for goods or services. 1.8. "Minimum Amount Due (MAD)": The minimum amount the Cardmember is required to pay by the Payment Due Date to keep the Card Account in good standing. 1.9. "Payment Due Date": The date by which the Cardmember must pay either the Total Amount Due or the Minimum Amount Due. 1.10. "PIN (Personal Identification Number)": A confidential numeric password used to authenticate transactions, such as Cash Advances at ATMs. 1.11. "Total Amount Due (TAD)": The total outstanding balance on the Card Account as of a specific statement date. 1.12. "Transaction": Any purchase, cash advance, or other charge made using the Card.

Article 2 — Card Issuance, Ownership, and Activation

2.1. Invitation Only: The Card is an exclusive facility offered to select individuals by personal invitation only. The Bank reserves the sole and absolute right to approve or decline any application based on its internal criteria, without assigning any reason. The invitation is non-transferable. 2.2. Bank's Property: The Card remains the property of HSBC at all times and must be returned to the Bank or its authorized representative immediately upon request. 2.3. Activation: The Card will be delivered in an inactive state for security reasons. The Cardmember must activate the Card through the methods prescribed by the Bank (e.g., net banking, mobile app, IVR) before use. 2.4. Card Validity and Renewal: The Card is valid until the expiry date printed on its face. The Bank may, at its discretion, renew the Card on expiry unless the Card Account is closed or in default.

Article 3 — Card Usage and Restrictions

3.1. Permitted Use: The Card is for bona fide personal and business expenses. The Cardmember undertakes not to use the Card for any illegal or prohibited activities, including but not limited to online gambling, purchase of prohibited articles, or any activity that violates national or international laws, including the regulations of the Reserve Bank of India (RBI) and the Foreign Exchange Management Act, 1999 (FEMA). 3.2. International Transactions: International usage of the Card is subject to FEMA regulations. The Cardmember is responsible for ensuring compliance. The Bank reserves the right to decline transactions that may violate these regulations. 3.3. Merchant Disputes: The Bank is not responsible for the quality, delivery, or performance of goods and services procured from any Merchant Establishment. Any dispute should be settled directly with the Merchant Establishment. The obligation to pay the charges incurred on the Card Account remains, irrespective of any such dispute.

Article 4 — Credit Limit & Dynamic Credit Facility

4.1. Credit Limit Assignment: The Bank will determine and assign a Credit Limit to the Card Account, which will be communicated to the Cardmember. This limit is subject to periodic review and may be revised at the Bank's discretion. 4.2. Enhanced Dynamic Credit Facility: This facility may permit transactions exceeding the assigned Credit Limit. Such approvals are not guaranteed and are assessed by the Bank on a case-by-case basis using proprietary risk algorithms. This facility does not constitute a permanent increase in the Credit Limit, and the Bank is not obligated to approve any such transaction. The Cardmember is liable for full payment of any amount exceeding the Credit Limit.

Article 5 — Billing, Payments, and Interest

5.1. Billing Statement: The Bank will send a monthly statement electronically to the Cardmember's registered email address, detailing all transactions, fees, interest, TAD, MAD, and the Payment Due Date. It is the Cardmember's responsibility to review the statement and report any discrepancies within 30 days of the statement date, failing which the statement will be deemed correct. 5.2. Payment Obligations: (a) To be exempt from interest charges on purchases, the Cardmember must pay the Total Amount Due in full by the Payment Due Date. (b) The Cardmember has the option to pay at least the Minimum Amount Due by the Payment Due Date to maintain the account in good standing. 5.3. Interest Calculation (APR): If the TAD is not paid in full, interest will be charged on the outstanding balance from the date of each transaction and on any new transactions until the entire outstanding balance is paid in full. Interest will also be levied on Cash Advances from the date of withdrawal. The applicable APR is specified in the Schedule of Charges. 5.4. 100-Day Interest-Free Credit: This promotional feature applies to select transactions as determined by the Bank. Its availability is strictly conditional upon the Cardmember having paid the TAD of the immediately preceding billing statement by its due date. Failure to meet this condition will result in the application of standard interest charges from the transaction date. 5.5. Mode of Payment: Payments may be made via cheque, demand draft, cash (at designated branches), net banking, auto-debit, or other channels offered by the Bank. The credit to the Card Account is subject to the realization of funds.

Article 6 — Schedule of Charges

All fees and charges are exclusive of applicable taxes (e.g., GST).

Article 7 — Benefits and Privileges (Third-Party Services)

7.1. General Disclaimer: All benefits, including but not limited to Lounge Access, Hotel Elite Status, Concierge Services, and Club/Golf Access, are provided by third-party vendors. HSBC acts solely as a facilitator and makes no warranty or representation regarding the quality, availability, or delivery of these services. 7.2. Program Changes: The Bank reserves the right to add, modify, substitute, or withdraw any partner program, benefit, or privilege at any time without prior notice to the Cardmember. 7.3. Liability: The Bank shall not be liable for any loss, damage, or claim arising from the Cardmember's use of these third-party services. All disputes must be resolved directly with the service provider, subject to their terms and conditions. 7.4. Rewards Program: Reward points are earned and redeemed as per the program's rules, which are subject to change. Points have no monetary value until redeemed and may be forfeited in the event of account default or closure. The Bank is not liable for any tax implications arising from the accrual or redemption of points.

Article 8 — Security, Lost/Stolen Cards, and Liability

8.1. Card and PIN Security: The Cardmember is solely responsible for the security of the Card, PIN, passwords, and the device linked to Safenet MobilePass+. The Cardmember must not disclose these to anyone. Any transaction authenticated using these credentials shall be deemed to have been authorized by the Cardmember. 8.2. Reporting Loss/Theft: In case the Card is lost, stolen, or the PIN/device is compromised, the Cardmember must IMMEDIATELY notify the Bank's 24-hour customer service. 8.3. Zero Liability: The Cardmember is protected by Zero Liability on fraudulent transactions occurring after reporting the loss to the Bank. The Cardmember may be liable for fraudulent transactions prior to reporting if gross negligence is established on the Cardmember's part. 8.4. Supplementary Cards: The Primary Cardmember is fully and unconditionally liable for all transactions and charges incurred on all Supplementary Cards issued on the account.

Article 9 — Data Protection and Privacy Consent

9.1. Consent to Disclose: The Cardmember hereby expressly authorizes the Bank to collect, store, use, and disclose any information related to the Cardmember, their account, and their transactions to its affiliates, service providers, credit information companies (e.g., CIBIL), regulatory bodies, and statutory authorities, both within and outside India, as required for service provision, credit assessment, risk management, marketing, legal compliance, or enforcement of this Agreement. 9.2. Marketing Consent: The Cardmember consents to receiving promotional materials and offers from the Bank or its partners through various channels like email, SMS, or phone, unless the Cardmember has explicitly opted out. 9.3. Privacy Policy: The Bank’s handling of personal data is governed by its detailed Privacy Policy, available on its official website.

Article 10 — Termination, Suspension, and Default

10.1. Termination by Cardmember: The Cardmember may terminate this Agreement by giving written notice, provided all outstanding dues on the Card Account are paid in full. 10.2. Suspension/Termination by Bank: The Bank may, at its sole discretion, suspend or terminate the Card privileges or close the Card Account at any time with or without prior notice upon the occurrence of a default, including but not limited to: (a) Failure to pay the Minimum Amount Due by the Payment Due Date. (b) Breach of any term in this Agreement. (c) Bankruptcy, insolvency, or death of the Cardmember. (d) The Bank perceiving a high credit risk. 10.3. Consequences of Termination: Upon termination, all outstanding balances on the Card Account become immediately due and payable.

Article 11 — Miscellaneous and Governing Law

11.1. Indemnity: The Cardmember agrees to indemnify and hold the Bank harmless against any losses, damages, liabilities, costs, and expenses that the Bank may incur as a result of the Cardmember's breach of these terms or any negligent or fraudulent act. 11.2. Notices and Communication: All notices and statements sent by the Bank to the Cardmember's last registered postal address or email address shall be deemed to have been duly delivered. 11.3. Amendment of Terms: The Bank reserves the right to amend any part of this Agreement at any time by providing at least 30 days' prior notice to the Cardmember. Continued use of the Card after the effective date of the change will constitute acceptance of the amended terms. 11.4. Force Majeure: The Bank shall not be liable for any failure or delay in performing its obligations if such failure or delay is caused by circumstances beyond its reasonable control, such as acts of God, war, civil unrest, or system failures. 11.5. Governing Law and Jurisdiction: This Agreement and all disputes arising hereunder shall be governed by the laws of India. The Cardmember and the Bank agree to submit to the exclusive jurisdiction of the competent courts in Chennai. 11.6. Grievance Redressal: For any grievances, the Cardmember may contact the Bank through its designated channels (Customer Care, Branch Manager). If the resolution is unsatisfactory, the issue may be escalated to the designated Grievance Redressal Officer and subsequently to the Nodal Officer, whose details are available on the Bank's website. 11.7. Severability and Waiver: If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect. Any failure or delay by the Bank in exercising its rights under this Agreement shall not constitute a waiver of those rights. 11.8. Entire Agreement: This Agreement, along with the MITC and application form, constitutes the entire agreement between the Cardmember and the Bank regarding the Card Account, superseding all prior oral or written communications.
